These booking conditions, together with your quotation, invoice and any ATOL Certificate, form the basis of your contract with Travelway Ltd (Company No. 04512846, ATOL 5964, IATA 91278364). Please read them carefully. The person making the booking accepts these conditions on behalf of everyone named on the booking.
1. Our role
Packages and flight-inclusive holidays: where we sell you a flight together with accommodation or other travel services, we act as the organiser of a package under the Package Travel and Linked Travel Arrangements Regulations 2018, and the booking is protected under our ATOL.
Flight-only bookings:we arrange flights as an agent for the airline. Your contract for carriage is with the airline, and the airline's conditions of carriage and fare rules apply. Where a flight-only booking is ATOL protected, you will receive an ATOL Certificate.
Other services:for stand-alone hotels, transfers, insurance and visa services we act as an agent for the supplier, and the supplier's terms apply.
2. Making a booking and paying
- A booking is confirmed when we receive your payment (or deposit) and issue a written confirmation.
- Deposit amounts and balance due dates are shown on your quotation or invoice. Many airline fares must be paid in full at the time of booking.
- If the balance is not paid on time, we may cancel the booking and apply the cancellation charges below.
- Please check your confirmation, tickets and names carefully and tell us of any errors immediately.
3. Prices
Fares and prices are subject to availability and can change until your booking is confirmed and paid. Once confirmed, the price of a package will only change in the limited circumstances allowed by law (such as changes in fuel costs, taxes or exchange rates), and we will give you at least 20 days' notice before departure. If the increase is more than 8% of the package price, you may cancel for a full refund.
4. Names, passports, visas and health
- Names must match each passenger's passport exactly. Airlines may charge to correct names.
- You are responsible for holding a valid passport (usually with at least six months' validity), the correct visas and any required vaccinations. Check FCDO travel advice at gov.uk/foreign-travel-advice.
- Where we help with a visa application, the decision rests solely with the relevant authority. Visa fees and our service fees are non-refundable if a visa is refused or delayed.
- Umrah: Umrah travel is subject to the rules of the Saudi Ministry of Hajj and Umrah, which can change at short notice, including visa conditions, age and vaccination requirements.
5. If you change or cancel
Changes and cancellations must be made in writing by the lead passenger. Airline tickets are subject to the fare rules of the ticket, and many fares are non-refundable or only partly refundable. You will pay any charges made by airlines, hotels and other suppliers, plus our administration fee as shown on your invoice. For packages, cancellation charges increase as the departure date approaches and are set out on your confirmation.
6. If we or a supplier change or cancel
Airlines may change schedules. We will tell you as soon as possible and help you with alternatives. If we make a significant change to, or cancel, your package before departure, you may accept the change, take an alternative, or receive a full refund, as set out in the Package Travel Regulations.
7. Travel insurance
We strongly recommend that every traveller holds suitable travel insurance from the time of booking, covering cancellation, medical expenses and repatriation.
8. Financial protection
Flight-inclusive packages and flights shown on your ATOL Certificate are protected by our ATOL (No. 5964). See our ATOL protection page for details. Packages that do not include a flight are protected in line with the Package Travel Regulations.
9. Our responsibility
For packages, we are responsible for the proper performance of all travel services in your package, subject to the limits and exceptions set out in the Package Travel Regulations and relevant international conventions. We are not responsible for events beyond our control, such as extreme weather, war, terrorism, epidemics or government action. Nothing in these conditions limits our liability for death or personal injury caused by our negligence.
10. Complaints
If you have a problem during your trip, please tell us and the supplier straight away so we can try to put it right. If you are still unhappy, write to us within 28 days of your return at info@travelwayltd.com and we will respond promptly.
11. Law
These conditions are governed by the law of England and Wales, and the courts of England and Wales.
